4. The Service and Wallet Features

4.1 What Kafel Wallet does

Kafel Wallet is a technology service that may help you: (a) create a wallet profile, (b) receive and send funds, (c) view transaction history, (d) participate in donation or fundraising workflows, and (e) access related features we may introduce from time to time.

4.2 No guaranteed availability

The Service may sometimes be unavailable due to maintenance, updates, network issues, or events outside our control. We do not guarantee uninterrupted access.

4.3 Transaction finality

Depending on how a transaction is processed (for example, card payments, bank transfers, or blockchain transactions), transactions can be irreversible or difficult to reverse. You are responsible for reviewing transaction details before confirming.

4.4 Not a bank

Unless we explicitly state otherwise in writing, Kafel is not a bank or a money transmitter. Some payment, payout, or identity features may be provided by regulated third-party providers.

5. Donations and Campaigns

5.1 Guest donations (no account)

We may allow donors to contribute without creating an account (“guest donations”). Guest donors may have limited access to receipts, history, or support flows compared to registered users.

5.2 Campaign managers, merchants, and beneficiaries

The Service may support multiple roles such as campaign managers, merchants, and beneficiaries. Each role may have different permissions and responsibilities. You agree to use role-based features only as authorized.

5.3 Donation intent

Donations are generally intended to support beneficiaries or campaigns. You are responsible for verifying the recipient details and any campaign information before donating.

5.4 Refunds

Refund eligibility (if any) depends on how the transaction was processed and the rules of the relevant payment provider. Unless required by applicable law, donations may be non-refundable.

We may charge fees for certain features (for example, processing, payout, platform, or service fees). Where required, we will disclose applicable fees before you complete a transaction.

You are responsible for any taxes, duties, or governmental charges associated with your use of the Service.

The Service may integrate third-party services (for example, payment processors, SMS/WhatsApp providers, analytics, cloud hosting, identity verification, or app store platforms). Your use of third-party services may be governed by their own terms and policies.

You agree to comply with all applicable laws, including anti-money laundering (AML), counter-terrorist financing (CTF), and sanctions laws. We may require identity verification or additional information to comply with legal obligations or third-party provider requirements.

We may suspend, limit, or refuse transactions if required by law, if requested by a payment provider, or if we reasonably suspect fraud, prohibited activity, or security risks.

12. User Content

You may be able to submit content (such as profile information, campaign descriptions, or support messages) (“User Content”). You represent that you have the rights to submit User Content and that it does not violate laws or third-party rights.

You grant Kafel a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display User Content solely to operate, improve, and provide the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAFEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

KAFEL DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. YOU ARE RESPONSIBLE FOR YOUR DECISIONS AND ACTIVITIES WHEN USING THE SERVICE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAFEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAFEL’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO KAFEL (IF ANY) FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Kafel and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms, pose a security risk, or if required by law or by a third-party provider. You may stop using the Service at any time.
